Aliado AI (hereinafter, "the data controller") is the data controller for personal data collected through this website and the AI assistant services on WhatsApp, Instagram, and Messenger.

2. Data we collect

We may collect the following personal data when you use our services or contact us:

• Communication data: messages sent through our AI assistants, including text, audio, and images.
• Browsing data: IP address, browser type, pages visited on our website.
• Account technical data: authentication identifiers, session status, and logs needed for security, abuse prevention, and support.
• Business data: information about your company needed to provide the services.

Your personal data will be processed for the following purposes:

• Provide and manage contracted AI assistant services.
• Handle inquiries, information requests, and technical support.
• Send commercial communications about our services (with your prior consent).
• Comply with legal and regulatory obligations.
• Improve our services and user experience.

4. Legal basis for processing

The processing of your data is based on the following legal grounds, in accordance with the Personal Data Protection Law of Ecuador (Organic Law on Personal Data Protection, published in Official Register Supplement 459):

• Performance of a contract: for the provision of contracted services.
• Consent: for sending commercial communications and processing sensitive data when applicable.
• Legitimate interests: for improving our services and securing our platforms.
• Compliance with legal obligations: when required by applicable law.

5. Retention period

Operational data is retained while the account or contract is active and for the time needed for support, security, and dispute resolution. Receipts, invoices, and tax data are kept for the periods required by applicable law. We do not use a single retention period for all data types.

The data subject may request deletion of data that is no longer necessary. Deletion may temporarily exclude rotating backups and records subject to a legal retention obligation.

6. Data recipients

We do not share your personal data with third parties except in the following cases:

• Meta: for WhatsApp, Instagram, or Messenger when the corresponding channel is enabled.
• Firebase Authentication: for authentication and technical identity management.
• OpenAI and other AI model providers: to process content where the configured function requires it.
• Infrastructure providers: for hosting, databases, storage, monitoring, and security.
• When required by a competent authority under law.
• With your explicit consent.

These providers act under their own terms or as data processors, as applicable. Only data necessary to perform the requested function is transmitted.

International transfers

Some providers may process data outside Ecuador. These international transfers are limited to services necessary to operate the account and are performed under contractual mechanisms and protection measures available with each provider.

7. Data subject rights

Under the Personal Data Protection Law of Ecuador, you have the following rights:

• Access: to know which personal data we are processing.
• Rectification: to request correction of inaccurate data.
• Erasure: to request deletion of your data when it is no longer necessary.
• Objection: to object to the processing of your data for specific purposes.

The site uses local storage and IndexedDB only as strictly necessary to keep the session via Firebase Authentication and to remember the technical state of the interface. We do not currently install Google or Meta ad tags or behavioral advertising cookies.

Links to external services, such as WhatsApp, may be subject to the provider's policies when opened outside this site.

10. Changes

We reserve the right to modify this privacy policy at any time. Changes will be notified through our website or via our regular contact channels.
